Description

HJR6 would violate separation of powers by intruding upon the regulatory authority of the Executive branch. Under current law, if the Legislature feels that the Administration has overstepped its authority in promulgating rules, any affected party can pursue legal action to have the rules annulled on those grounds. If passed, this Constitutional Amendment would transfer authority to determine legality of regulatory rules from the Judiciary to the Legislative branch, yet a further violation of separation of powers.
